1. Scope of application / Delivery times

  1. The execution of transactions and the collection of merchandise are undertaken exclusively in accordance with these General Terms and Conditions of Sale, which serve as the basis for all contracts concluded with us, NB NewBoots AG, whose head office is located on Industriestrasse 55, 6312 Steinhausen, Switzerland, registered under the company identification number (IDE/UID) CHE-163.435.338, in particular with regard to the products and services offered on the pages of the skidahu.ch website. Any general terms and conditions conflicting with or deviating from the provisions outlined below shall not apply without our written agreement. The General Terms and Conditions of Sale outlined below shall apply exclusively, even when we provide services with no further restrictions and in full knowledge of the existence of conditions conflicting with or deviating from these General Terms and Conditions of Sale. By accepting the products and services offered in particular on the pages of the skidahu.com website, you agree unconditionally with these General Terms and Conditions of Sale at the moment of purchase. If you do not agree with these General Terms and Conditions of Sale, do not buy the product or service that we offer.

  2. The term “consumers” mentioned in these General Terms and Conditions of Sale applies to natural persons placing an order with a purpose that cannot be attributed to a commercial, independent or liberal activity. As for the term “entrepreneurs”, this qualifies natural or legal persons or companies with a legal capacity placing an order within the context of their commercial, independent or liberal activity. For the purposes of these General Terms and Conditions of Sale, “customers” may be either consumers or entrepreneurs.

  3. When lead-times are indicated in working days, these correspond to all the days of the week except Saturday, Sunday and public holidays that are legally recognised in Zug, Switzerland.


2. Registration

  1. When entering the personal data necessary for registration, you are liable for providing complete and correct information. You are obliged to treat personal access data confidentially and to prevent any non-authorised third-party accessing it. Registration confirmation shall immediately follow the sending of registration information by clicking on the button.

  2. You must abstain from any disturbance of web pages and any other usage of data outside the scope of the use respectively intended within the interior of the platform. Any manipulation with the purpose of obtaining non-authorised payments or other advantages to our detriment or to the detriment of other members may in particular—in addition to legal consequences—lead to the denial of access. The status of member grants the former the right to use the online offering, according to respective availability, and to use the content for private and non-commercial purposes.

  3. Each customer may only hold one customer account at a time. We reserve the right to delete multiple registrations and to issue a warning or serve notice to members contravening the provisions stipulated in points 2.1 to 2.4 of these General Terms and Conditions of Sale, or even to delete or modify content.

  4. We are not obliged to accept a customer’s registration or to permanently maintain the availability of our products and services. All our products and services are only valid subject to available stocks. In principle, any orders already confirmed by us are not affected by this; if need be, we shall reimburse the price paid.


3. Possibility of saving and consulting the contract wording

  1. You may consult these General Terms and Conditions of Sale on the website of our store at the address www.skidahu.com under the General Terms and Conditions of Sale heading. In addition, you may print or save this document by using the usual function of your Internet access software (= browser: most frequently “File” -> “Save as”). To open the PDF file, you will need the Adobe Reader free software (from www.adobe.com) or another similar programme that can handle the PDF format.

  2. You may also easily archive your order information, either by downloading the General Terms and Conditions of Sale and saving the summarized data on the final page of the order process in the online store using the functions of your Internet browser, or by waiting to receive the automatic reply confirming the details of your order that we shall send by e-mail to the address you indicated, once the order has been placed. This order confirmation e-mail contains your order information as well as these General Terms and Conditions of Sale and may easily be printed off or saved using your e-mail programme.


4. Conclusion of contract

  1. During the order process, please carefully check your information before clicking on the “Confirm” button.

  2. By clicking on the “Confirm” button, you are sending a firm order concerning the merchandise contained in the basket. The order confirmation immediately follows the sending of the order, on the condition that payment has been successfully made.

  3. A firm contract is concluded as soon as we send you an order confirmation.


5. Prices

  1. The prices indicated in the offering at the moment of ordering shall apply to orders made in our online store. These are the final prices including the applicable statutory VAT. The prices, to which delivery charges are added, are payable at the moment the order is placed.

  2. PLEASE NOTE: THE MERCHANDISE ORDERED SHALL ONLY BE DELIVERED TO THE CUSTOMER FOLLOWING FULL PAYMENT OF THE AMOUNT DUE, INCLUDING DELIVERY CHARGES.


6. Payment

  1. We only accept payment by Stripe and Paypal.

  2. You agree to receive your invoices exclusively in electronic form.

  3. In the event that it becomes impossible for NB NewBoots AG to deliver the merchandise ordered or a substitute product accepted by the customer within a reasonable deadline, we shall reimburse the amount of the order without delay. ALL OTHER FORM OF COMPENSATION IS EXPRESSLY PRECLUDED.

7. Delivery

  1. The merchandise ordered and paid for shall normally be delivered within 4-5 days to the address indicated by the customer during the order process.

  2. In the event of force majeure, the delivery deadlines may be pushed back appropriately. The following are considered to be cases of force majeure: strike action, lock-out, government intervention, shortage of raw materials or energy, transport difficulties for which we are not responsible, operational obstacles for which we are not responsible, for example, due to fire, water or to machine damage and any other obstacles that may objectively be considered as not being our responsibility or fault. We shall immediately inform you of the beginning and the end of such obstacles. If the obstacle resulting from the aforementioned cases persists for 4 weeks beyond the initially scheduled period of merchandise collection, you are within your rights to cancel the contract. No additional claim, particularly for damages, exists.

  3. The risk of loss and damage to the merchandise sold passes to the customer as soon as it is given to the shipper.


8. Return Policy

At Dahu, we are committed to the quality of our products and the satisfaction of our customers. Return labels are available within 20 days of your purchase date provided the item(s) meet the return conditions:

  • Boots are unused/undamaged
  • Original tags still attached
  • Boots are in the original packaging

Any shipping fees on the original order are final and will not be refunded. The cost of the return is the responsibility of the customer. Upon inspection and approval of the returned items, the full cost of purchase less any paid for shipping costs will be refunded. Please note all Outlet product sales are considered final sale and are not eligible for return.

How to return your purchase:
  1. All returns require a return authorization number.
  2. Please contact us at contact@skidahu.ch with your order number and reason for return.
  3. Our customer service team will review the return request within 2 business days of receiving the request.
  4. Upon approval, we will provide the return address and Return Authorization # via email to you.
  5. Please allow up to 5 business days for your return to be processed after delivery, and 14 business days for any applicable refunds.


9. Guarantee and claims management

  1. Notifications of defects must be reported without delay, by precisely indicating the nature of the defect and all useful order information as well as your customer number.

  2. The legal provisions in terms of guarantees for defects in sales are applicable.

  3. We attach great importance to customer satisfaction. You may contact us at any time by e-mail at contact@skidahu.ch. We shall do our best to bring you satisfaction as soon as possible.

10. Applicable law, competent court

  1. Swiss law is applicable to all legal acts and other legal relationships between the customer and ourselves. The application of the United Nations Convention on international merchandise sales contracts (Vienna Convention) is precluded.

  2. WITHIN THE LIMITS OF APPLICABLE LAW, ALL DISPUTES THAT MAY ARISE FROM THESE GENERAL TERMS AND CONDITIONS OF SALE AND THE CONTRACT SHALL BE SUBJECT TO THE EXCLUSIVE COMPETENCE OF THE COURTS WHERE WE ARE DOMICILED IN THE CANTON OF VAUD.


11. Amendments to the General Terms and Conditions of Sale

We reserve the right to amend these General Terms and Conditions of Sale at any time. Orders that have already been confirmed by us before any amendment shall not be affected.


12. Severability clause

In the event that certain isolated provisions of the contract, including these regulations, should prove to be partially or entirely inapplicable, or should even become so, or if the contract contains an unforeseen lacuna, this would however in no way restrict the validity of the remaining provisions or parts of the said provisions. The respective legal regulations shall then replace the inapplicable or missing provisions.
